Guernsey Court of Appeal grants Guernsey Financial Services Commission permission to appeal
25 August 2023
A single judge of the Court of Appeal has granted the Guernsey Financial Services Commission (the Commission) permission to appeal a decision of the Royal Court.
The decision being appealed is that of Her Honour Lieutenant-Bailiff Marshall KC in Domaille, Clarke and Hannis v Guernsey Financial Services Commission [2023] GRC017. In that judgment, Lieutenant-Bailiff Marshall had allowed an appeal brought by the Respondent directors and officers of a licensee against sanctions imposed by a Senior Decision Maker of the Commission.
Granting permission to bring the appeal, Helen Mountfield KC observed that aspects of the appeal raised an important question law and issues which in the public interest should be examined by the Court of Appeal.
Mourant acted for the Commission in the application for permission to appeal.
