Filing deadline: 2022 Annual Declaration for Registered Persons
03 December 2021
In this Update, we remind Registered Persons under the Securities Investment Business Act (2020 Revision) of the approaching filing deadline for the 2022 Annual Declaration and annual fee.
Filing deadline
Registered Persons are required to file a completed Annual Declaration form with the Cayman Islands Monetary Authority (CIMA) by 15 January each year, together with payment of an annual fee. The 2022 Annual Declaration will cover the period from 1 January 2021 (or the date of registration during 2021) to 31 December 2021.
Failure to pay the annual fee by the deadline will result in a surcharge of one-twelfth of the outstanding fee for every month or part of the month the fee is not paid.
CIMA Notice
CIMA has recently issued a Notice providing that the 2022 Annual Declaration form for Registered Persons will be available for completion from 1 January 2022. The Annual Declaration form must be filed via CIMA's Regulatory Enhanced Electronic Forms Submission (REEFS) platform.
As this does not allow much time for Registered Persons to complete the form by the 15 January 2022 deadline, we recommend referring to Section 4 of the REEFS Form Completion Guide: Annual Declaration of a SIBA Registered Person, which is available on REEFS and CIMA's website, to begin preparing the relevant information in advance..
The Notice also provided a reminder that all material changes made by a Registered Person prior to 31 December 2021 should be submitted to CIMA prior to submission of the Annual Declaration form via the email address contactsecurities@cima.ky.
