Since the Privy Council decision in Grand View v Wong, trustees have rightly been concerned about how to deal with changing circumstances and settlor wishes. This is because, even where a trustee is acting within the scope of its powers, there is an inherent limitation on their exercise in that they must be exercised for a proper purpose. Our panel will consider how to find the proper purpose of a power and best practice for trustees dealing with trust structures in light of the same.
