In Asia, the long tail of financial instability which followed the last global financial crisis resulted in the collapse of a number of well-known property developers that had been financed both onshore within the People's Republic of China (PRC) and offshore to the PRC. A significant portion of indebtedness was ultimately refinanced and/or restructured in the last bear market cycle; however the practical conundrum of enforcement by offshore interests against onshore PRC assets remains squarely at the forefront of investors' minds.
Does increased cross-border PRC and HKSAR reciprocity for insolvency appointment-takers herald a brave new world of enforcement or are good news (enforcement) stories still likely to be few and far between?
